WHY IS THIS IMPORTANT?

This document outlines the terms and conditions for your Klarity account and its associated services, applicable whether accessed through the Klarity.health website or the Klarity mobile apps (available on iOS and Android). This legal agreement exists between you, the account holder, and Managed Self Limited trading as Klarity. These terms, in conjunction with the Privacy Policy and other relevant service terms, constitute the agreement. You can review these terms on the Klarity app or website at any time. To utilise the app’s full functionality, Internet connectivity is required. For a comprehensive understanding of your account, you may refer to our Frequently Asked Questions (FAQs). Use of the Klarity service through mobile applications is subject to the rules of the respective application stores (e.g., Apple App Store, Google Play). If you disagree with these terms, refrain from using the website or the app. Any revisions to this legal notice will be communicated via email to registered users.

WHAT IS A KLARITY ACCOUNT?

Klarity account provides access to our Android and iOS apps. By creating an account, you affirm that you have read and accepted these Terms & Conditions and our Privacy Policy.

OUR SERVICES

Chronic disease, cancer biological age and other Health Scores:

You can utilise the health score functionality to assess and enhance your general well-being. By sharing self-reported and wearable data anonymously, you enable personalised responses and recommendations based on referenced external research.

Personalised Health Plans:

Built on both propitiatory AI and Generative AI our personalised health plan uses the risk predictions to build comprehensive, personalised health plans.

Cancer Screening Programmes:

Klarity offers cancer screening programmes that assess individual risk levels for various types of cancer using a comprehensive questionnaire and proprietary risk prediction models. Based on the results, we recommend specific screening tests, which may include at-home sample collection kits or clinic appointments. For the latter, we partner with third parties, including The Mole Clinic for skin cancer checks and Scan.com for mammographies. For full blood draws, we utilise the services of Bloodsandbeyond as mobile phlebotomists. The collected blood samples are processed by The Doctors Laboratory.

Other Services:

We may modify and enhance services periodically, introducing improvements or additional features. Mandatory updates may be required for continued access.

HOW DO I OPEN A KLARITY ACCOUNT?

Residents of the United Kingdom aged 13 or older can create an account. Users outside the UK may also use the service, but certain features may not be applicable. If under 13, a Child may register with parental consent. Account sharing is prohibited. Account creation requires name, email, and a secure password. Users are responsible for account security, including password protection and adherence to technical requirements.

COMMUNICATING WITH YOU

Communication will primarily be through the app or website, with occasional email updates. Users can manage communication preferences in the app’s “Settings” section. Keep account details current. Closure can be done through the “Settings” area.

Account Protection: We prioritise account and data security, utilising encryption for data transmission and storage. Users are urged to choose strong passwords, maintain mobile and email security, and report unauthorized access promptly.

Usage Restrictions: Users must act reasonably and responsibly, avoiding illegal or harmful activities. Respectful communication is expected. Account closure may occur if security concerns arise.

Changes to Terms: Terms may be revised for clarity, improvement, legal compliance, business operation changes, or new service introductions. Users will be notified of changes.

ACCOUNT AND INFORMATION RESPONSIBILITY

Service interruption, faults, or third-party disruptions may occur. We are responsible for the accuracy and quality of internally generated content but not external content. Users retain responsibility for their data. Information on health advice, therapy, diagnosis, treatment, or external websites is not our liability.

PERMISSION FOR US TO PROCESS YOUR PERSONAL INFORMATION

To provide services under the agreement we need to collect information about you. Under data protection law, we are what is known as the “data controller” of your personal information. We own all the intellectual property in our products (for example, the content in our app and on our website and our logo). You must not use our intellectual property as your own, except to enjoy our products. You also must not reverse-engineer any of our products (that is, reproduce them after a detailed examination of their construction or composition).

Our contract with you:

Only you and we have any rights under the agreement.
The agreement is personal to you and you cannot transfer any rights or obligations under it to anyone else.

Our right to transfer: We will only transfer any of your and our rights or obligations under the agreement if we reasonably think that this won’t have a significant negative effect on your rights under these terms and conditions or we need to do so to adhere to any legal or regulatory requirement. English law applies: The laws of England and Wales apply to these terms and conditions.

The English version of the agreement applies: If these terms and conditions are translated into another language, the translation is for reference only and the English version will apply.

Our right to enforce the agreement: If you have broken the agreement between you and us and we don’t enforce our rights, or we delay in enforcing them, this will not prevent us from enforcing those or any other rights at a later date.

Taking legal action against us: If you want to take legal action against us in the courts, only the courts of England and Wales can deal with any matter relating to these terms and conditions.date.
