1. Introduction

These Terms and Conditions (“Terms”) apply to your use of the Klarity app (iOS and Android) and the website at klarity.health (together, the “Services”). They form a legal agreement between you (“you”, “your”) and Managed Self Ltd trading as Klarity (“we”, “us”, “our”).

By creating a Klarity account or using our Services, you confirm that you have read and accept these Terms together with our Privacy Policy and Data Sharing Policy. If you do not agree, you must not use our Services.

Use of the mobile apps is also subject to the rules of the relevant app store (e.g. Apple App Store, Google Play).

2. Klarity account

A Klarity account provides access to our apps and services.
You must be at least 13 years old to register. Users under 13 may only register with parental consent.
Accounts may not be shared. You are responsible for keeping your login credentials secure.
To create an account, you must provide your name, email address and a secure password.
You must keep your account details up to date.

3. Our services

3.1 Health scores

We provide tools such as health scores, chronic disease and cancer risk assessments and biological age indicators. These are based on self-reported and wearable data and are intended to help you understand your general wellbeing.

3.2 Personalised health plans

We use proprietary and generative AI models to build personalised health plans. These provide insights and recommendations but are not a substitute for professional medical advice.

3.3 Cancer screening programmes

We assess your risk levels using questionnaires and risk models. Based on results, we may recommend specific screening tests, which may include:

at-home sample collection kits
clinic appointments (e.g. mammograms via Scan.com, skin checks via The Mole Clinic)
mobile phlebotomy services via Bloodsandbeyond, with samples processed by The Doctors Laboratory.

3.4 Service updates

We may modify or enhance services from time to time, including mandatory updates required for continued use.

4. Communication with you

We will communicate with you mainly through the app and website, and occasionally by email.
You can manage your communication preferences in the app settings.
It is your responsibility to ensure your contact details remain up to date.

5. Security and acceptable use

We apply encryption and security measures to protect your data.
You must choose a strong password and maintain the security of your devices and email account.
You must not misuse the Services (e.g. hacking, introducing malware, posting unlawful or offensive content).
We may suspend or close accounts where security is compromised or these Terms are breached.

6. Your responsibilities

You are responsible for ensuring that the information you provide is accurate and up to date.
Klarity is not responsible for decisions you make based solely on the information provided.
Our services are intended to support, not replace, professional healthcare advice, diagnosis or treatment.

7. Intellectual property

We own all intellectual property rights in the Services, including app and website content, branding and logos. You may use these only as required to access the Services. You must not copy, adapt, reverse engineer or use our intellectual property for any other purpose.

8. Legal terms

Contractual parties: Only you and Klarity have rights under this agreement.
No transfer by you: You may not transfer your rights or obligations to anyone else.
Transfer by us: We may transfer rights or obligations where it will not significantly affect your rights, or if required by law or regulation.
Governing law: These Terms are governed by the laws of England and Wales.
Jurisdiction: The courts of England and Wales shall have exclusive jurisdiction.
Language: If these Terms are translated, the English version shall prevail.
Non-waiver: If we delay or fail to enforce any right, that does not prevent us from enforcing it later.

9. Information rights

We act as data controller of the personal information we collect. Under UK GDPR you have rights including: access, rectification, erasure, restriction, portability, objection and withdrawal of consent. For details, see our Privacy Policy.

10. Website conduct

Other than personal information (covered by our Privacy Policy), material you transmit or post to our website will be treated as non-confidential and non-proprietary. We may use such material for any purpose.

You must not post or transmit material that is:

likely to incite violence or hatred
technically harmful (e.g. viruses, worms, Trojan horses)
in breach of intellectual property rights or licences.

We may cooperate with law enforcement authorities or comply with court orders requiring us to disclose the identity of anyone posting such material.

11. Liability

We provide services with reasonable care and skill, but we do not guarantee that they will be uninterrupted, error-free or fit for every purpose.
To the maximum extent permitted by law, we exclude liability for indirect, incidental or consequential losses.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under law.

12. Changes to these Terms

We may revise these Terms from time to time to reflect changes in law, business needs or service improvements. We will notify registered users of material changes. Continued use of the Services after changes take effect constitutes acceptance.
